On December 19, 2013 it was reported that police are now charging the operator who allegedly caused a fatal car crash on August 24, 2013 with drunk driving and distracted driving. The crash occurred on August 24, 2013 on Stevens Street in the area of Cherry Hill Drive just before 8:30 a.m. It is alleged that the defendant operator crossed the center line and struck an oncoming vehicle that had four occupants. One of the occupants died, and another was allegedly severally injured. The two other occupants were also reportedly injured. The defendant operator has now been charged with first-degree manslaughter, second-degree manslaughter with a motor vehicle, second-degree assault, operating under the influence of drugs, failing to drive right, using a cell phone, distracted driving and failure to wear a seatbelt. These charges come at a time when new studies confirm the dangers of distracted driving, and as the 2013 holiday season approaches, unfortunately a time when drunk driving traditionally increases with the prevalence of holiday parties. The number of pedestrian deaths caused by distracted driving has risen dramatically in recent years, according to a study conducted recently at the University of Nebraska Medical Center. By analyzing crash data pulled from the Fatality Analysis Reporting System, a database of fatal traffic accidents maintained by the federal government, UNMC researchers concluded that the number of pedestrians killed by distracted drivers in the U.S. spiked over 30 percent from 2005, when there were 344 such deaths, to 2010, when there were 500. The number of bicyclists killed by distracted drivers also increased substantially during this period, from 56 fatalities to 73. Additionally, a 2012 survey conducted by AT&T found that adult drivers were actually more likely than teen drivers to admit to texting while driving. More than 40 percent of people between 19 and 39 years old say they text while they drive, and 10 percent of them say they do it regularly. More than half of those questioned in a new survey by the AAA Foundation for Traffic Safety say they talk on their cellphones while driving. The AAA foundation survey builds on the group’s earlier work, a comprehensive study by researchers at the University of Utah. Released this past summer, the report found that the more complicated and absorbing a task becomes — such as text messaging or a phone conversation — the greater the distraction. And the longer any such task takes, the more absorbing it becomes. Drunk driving spikes during the holiday season. Data from a number of organizations shows that binge drinking and drunk driving increase astronomically during the holidays, beginning with Thanksgiving Eve – which is now termed “Blackout Wednesday” in many cities. The data, released by Alcohol Monitoring Systems as part of their annual public awareness campaign, paints a picture of high-risk drinking and increased rates of DUI injuries and deaths during the 36-day holiday season. According to the Centers for Disease Control and Prevention, 728 people will be injured or killed each day between Thanksgiving and New Year’s Day in drunk driving accidents, a rate two to three times higher than the rest of the year.
