MUNICIPAL LAW – Appellate Court holds that police report attached to notice of claim adequately identified defect in street:

The plaintiff was involved in a two-vehicle accident that allegedly resulted from a loose manhole cover.  The plaintiff’s statutorily-required notice of claim simply identified a loose manhole cover in East Main Street, just east of its intersection with Crystal Street, Stamford.  The notice also attached a copy of the police report, which included a diagram depicting the location of the manhole.  Rejecting the city’s claim that the notice itself did not identify which of four manholes was involved, the court held that the reference to the police report, which did identify the particular manhole, was sufficient.  Ding v. Lazaro, AC 38297 (3/14/17)
