Attorney Peter K. O’Keefe obtains defendant’s verdict in van versus bus lawsuits

On June 4, 2015, Attorney Peter K. O’Keefe obtained defendant’s verdicts in two lawsuits arising out of an alleged commercial van’s collision with a bus.

The three plaintiffs were passengers on the bus.  They alleged that the van driver drove into the side and/or mirror of the bus causing the bus to suddenly move, throwing the plaintiffs from their seats and causing them to sustain soft tissue injuries.  The bus driver claimed that van driver slammed into his mirror, causing the bus to jerk slightly.  An independent witness claimed that she heard the van’s mirror strike the bus mirror.  The plaintiffs also argued that the bus was moving and that it suddenly stopped in response to the van cutting the bus off.

Liability and damages were vigorously defended.  Each of the plaintiffs had emergency room visits and in excess of $ 6,000 in medical bills.  Despite the fact that the plaintiffs were passengers, the jury did not believe that the plaintiffs established any negligence on the part of the van driver or the bus driver.

The jury returned a defendant’s verdict as to all three plaintiff’s claims after approximately 30 minutes of deliberations.
