INSURANCE COVERAGE: Court finds insurance company must defend negligent insured despite criminal conduct

After Donte Tenn injured another individual with a baseball bat and the actions were considered criminal, Tenn’s insurance company moved for a Motion for Summary Judgment, arguing that it was not required to defend its insured for criminal actions in a civil lawsuit. The Court denies the motion, as the Allstate insurance policy covered the individual for negligent acts, and the Complaint against the insured contained only conclusory allegations that the criminal actions were intentional.
