PERSONAL INJURY: Attorney’s testimony as to client with Alzheimer’s held inadmissible

The Connecticut Superior Court grants a motion to preclude testimony from the plaintiff’s prior attorney with regard to conversations as to how the plaintiff allegedly slipped and fell on a sidewalk.  The plaintiff had testified at a deposition that she could not recall the slip and fall due to her Alzheimer’s condition.

The court holds that the former attorney’s testimony regarding conversations with the client was inadmissible and did not qualify under the residual exception to the rule barring hearsay testimony.
