Q: Who is Liable for the Dog that Bit Me?

A: For the most part, the owner or keeper of the dog would be liable. Their insurance company will usually cover a situation such as this, unless the animal was excluded from the owner’s policy.  The property owner where the bite or attack took place can be liable as well under same circumstances.

Q: Why do people hesitate to pursue dog bite cases?

A: Often, there is a relationship between the bite victim and the owner of the dog.  This will hinder someone pressing charges. They should know that the claim will go against the dog’s owner’s insurance company, so it rarely has an effect on the owner personally.

Q: If I was accused of provoking the dog, causing it to bite, does it mean that I don’t have a case?

A: Just because you were accused does not mean that you don’t have a case.  If you were beating a dog and it defends itself, that is one thing, but if you were petting a dog and it attacks you causing injury, you may be able to recover.  Even if the owner’s insurance company accuses you, your injury can prove otherwise.

Q: How long do I have to file a dog bite claim?

A: The statute of limitations for filing a dog bite claim is two years from the date of the bite.  It is recommended to report the claim as soon as possible.  This will prevent any loss of evidence that may help your case.
